Welcome to Myhappr. These Terms of Service ("Terms") govern your access to and use of the Myhappr platform, website, APIs, and related services (collectively, the "Service"). By accessing or using Myhappr, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Service.

Myhappr is owned and operated by MYHAPPR LIMITED, a private company limited by shares incorporated under the laws of the Federal Republic of Nigeria with Company Registration Number (RC) 9481569.

1. Eligibility & Account Ownership

To access or use Myhappr, you represent and warrant that:

  • You are at least 16 years of age. If you are below the legal age of majority in your jurisdiction, you have permission from a parent or legal guardian where required.
  • You possess a valid, legally recognized bank account or mobile money wallet registered strictly in your own legal name (verified via your government-issued identity/NIN at the bank level).
  • All payout and banking details you provide belong exclusively to you. You must not configure bank accounts belonging to parents, guardians, friends, proxies, or any third parties to receive your creator earnings.
  • All registration, identity, and contact information you provide is true, accurate, and kept up to date.

2. Description of Service

Myhappr is a creator support platform that enables African creators to receive voluntary financial contributions ("Tips" / "Donations" / "Gifts" / "Smiles") from supporters worldwide, and withdraw earnings to supported local bank accounts and mobile money rails. We continually improve our platform and reserve the right to update, modify, or discontinue features at any time.

3. Account Registration & Security

  • You are responsible for safeguarding your login credentials, withdrawal PINs, and authentication tokens.
  • You must immediately notify Myhappr at support@myhappr.com if you suspect unauthorized access or security breaches on your account.
  • You are solely responsible for all activities and transactions conducted under your account. Myhappr is not liable for losses arising from compromised credentials or user negligence.
  • Username Ownership & Reclamation: You do not own your username or profile URL handle. Myhappr reserves the right to reclaim, rename, reassign, or release any username or handle at our sole discretion, including but not limited to handles associated with suspended or terminated accounts, trademark or intellectual property violations, username squatting, or the impersonation of public figures, artists, businesses, charities, or organizations.
  • Email Address Permanence: To maintain strict financial security, prevent account hijacking, and preserve audit trails, the email address used to register your account is permanent. You cannot change your registered email address under any circumstances.

4. Prohibited Conduct & Anti-Fraud

You strictly agree not to use Myhappr for any unlawful, fraudulent, or abusive purposes, including but not limited to:

  • Financial Fraud: Using stolen debit/credit cards, unauthorized bank accounts, fraudulent payment methods, or initiating illegitimate chargebacks.
  • Money Laundering & Illicit Financing: Engaging in money laundering, terrorist financing, pyramid schemes, or cash recycling operations.
  • Impersonation & Deception: Impersonating another individual, creator, business, or public entity to solicit donations under false pretenses.
  • Illegal Content & Harassment: Promoting illegal services, hate speech, extortion, harassment, or unauthorized intellectual property infringement.
  • Sexually Explicit & Adult Content: Uploading, displaying, linking to, or distributing pornographic, sexually explicit, suggestive, or nude content in profile avatars, cover photos, bios, project pages, or communications. Myhappr strictly prohibits adult and sexually suggestive media to maintain a safe platform and ensure full compliance with regulatory and payment network standards. Any account found uploading, displaying, or sharing adult or sexually explicit content will be immediately and permanently suspended.
  • System Exploitation: Attempting unauthorized access, probing vulnerabilities, scraping platform data, introducing malware, or manipulating platform rankings and rewards.

Violation of these conduct rules will result in immediate account suspension, forfeiture of illicit funds, blacklisting, and referral to relevant law enforcement agencies.

5. Payments, Fees & Finality of Tips

Our fee structure is transparent and designed to maximize creator earnings:

  • Creator Earnings: Creators receive 100% of the base donation amount. Platform, payment-processing, and creator payout fees are charged on top to the supporter.
  • Platform Fee: Free plan donations carry a 5% supporter fee. For creators with an active Pro subscription, this 5% fee is waived (0%).
  • Creator Payout Costs: A creator payout fee is shown and charged at supporter checkout. Creator withdrawals are 100% free and send the full available balance without deducting a withdrawal fee. Settlement rules and minimums still apply. Historical fee records remain unchanged.
  • Third-Party Processing Fees: Standard third-party processing fees charged by our licensed payment gateways are applied to checkout transactions.
  • Checkout Currencies: Supporters can choose NGN, GHS, KES, USD, CAD, EUR, or GBP at checkout. Myhappr converts the base tip into the creator's configured payout currency. Available payment methods and successful authorization remain subject to the payment provider and card issuer.
  • Finality of Tips (No Buyer Remorse Refunds): All tips, donations, and payments sent to creators represent voluntary financial gifts and are considered final and non-refundable once processed. Supporters cannot cancel or reverse settled tips simply due to a change of mind.
  • Fraud Investigations: In verified cases of unauthorized card fraud reported through our payment partners, transactions are reviewed and handled in accordance with payment network and banking regulations.

6. Payouts & Third-Party Processors

Creators can withdraw cleared earnings to verified bank accounts or mobile money wallets in supported payout regions (including Nigeria, Ghana, and expanding markets).

  • Settlement Periods: Local-currency (KES, GHS, NGN) tips are typically available on the next business day. International-currency (CAD, EUR, GBP, USD) tips are subject to a five business-day settlement period before becoming withdrawable. Weekends and public holidays can extend these timeframes.
  • Business Days: Bank payouts are processed on official banking business days (Monday to Friday, excluding public holidays).
  • Third-Party Service Disclaimer: Payouts and payment processing are executed via licensed payment gateway partners and intermediary financial institutions. Myhappr is not a bank and does not hold a banking license. Myhappr shall not be liable for settlement delays, maintenance windows, or service interruptions caused by third-party banks or payment networks.

7. Pro Subscription

Myhappr Pro is a voluntary premium subscription for creators:

  • Monthly Billing: Paid Pro subscriptions renew automatically through Flutterwave until cancelled. Creators can cancel from Billing and retain Pro access until the end of the current billing period. Gifted or promotional access does not charge the recipient or automatically renew.
  • Cancellation: If a creator cancels their subscription, their account seamlessly reverts to the Free tier at the conclusion of the billing period without penalty.
  • Refunds: Pro plan refund requests are evaluated on a case-by-case basis via support@myhappr.com.

8. Intellectual Property

You retain full ownership of all text, media, graphics, and branding you upload to your Myhappr creator page. You grant Myhappr a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of operating the Service. All Myhappr platform software, trademarks, UI designs, code, and branding remain the exclusive property of MYHAPPR LIMITED.

9. Suspension & Termination

We reserve the right to suspend, restrict, or terminate your access to the Service immediately, with or without prior notice, if:

  • You breach any provision of these Terms, including prohibited content and adult imagery rules.
  • We detect fraudulent, illegal, or high-risk activity on your account.
  • Required by court order, law enforcement, or regulatory compliance.
  • Your account poses security risks to Myhappr or its community.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Myhappr makes no express or implied warranties that the service will be uninterrupted, error-free, completely secure, or free from harmful components. You access and use the Service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MYHAPPR LIMITED, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption.

Myhappr's aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the total amount of platform fees earned by Myhappr from your account in the twelve (12) months preceding the incident.

12. Indemnification

You agree to defend, indemnify, and hold harmless MYHAPPR LIMITED, its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

13. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any legal action or proceeding shall be instituted exclusively in the competent courts located in Nigeria.

14. Force Majeure

Myhappr shall not be held liable for any delay or failure in performance resulting directly or indirectly from causes beyond its reasonable control, including natural disasters, banking network failures, telecommunications breakdowns, power outages, cyberattacks, or governmental directives.
